And apparently it isn't a Transformers character (http://www.seibertron.com/transformers/news/michael-bay-on-the-identity-of-the-silver-mercedesbenz-sls-amg/21277/) - at least in the Movie.
As with previous attempts to have certain cars as Decepticons, apparently MB blocked the usage of their vehicle as 'evil'.

But I don't see how a car company, desperate for media exposure during these tougher times in the auto industry, could prevent Bay from doing anything he wanted. He'd just simply say to them, 'This car will be a Decepticon, or else I'll get a different car company to play the role to millions of viewers'.

I thought there was another Mercedes in the film? A blue E550?

Perhaps HasTak will make a toy based on this vehicle and cleverly make it transform into a Not-Mercedes (much like how ROTF Sideways is a Not-Audi ;)). Even if the vehicle isn't a Transformer in the film wouldn't necessarily stop HasTak from making a Transformer toy of it (e.g. Longarm, Landmine, Stockade etc.).

Michael Bay says a lot of things. Remember how he said nobody had ROTF's script besides himself and a few other movie production people (how did he expect Hasbro and its accompanying subsidiaries and licensees to be able to make merchandise without the script?)? Remember how he said in Empire (the magazine) that Megatron was not coming back and that any ROTF Megatron tank toy was just a toy?

While there's always a chance deals can fall through (though it's extremely unlikely this late in the game), Soundwave has already appeared in robot mode in the DOTM prequel comics, with a Mercedes logo on his chest.
