Wouldn't Phillip Morris' legal team already be aware of Takara's intent to distribute locally & worldwide anyway?

They would, but at least if we don't get a legal demand to desist in promoting or advertising the item, or assist in acquiring one through any source, we can claim that we were not aware of it.
And just hope that PM hasn't filed something with Customs to screen for it, based on it being designated cigarette advertising or a childs toy related to cigarettes.

When I used to work for one of the two main grocery chains and it was my day for picking cigarettes for the stores, it was like looking at a set of trading cards... and I would often look out for any new ones and read their descriptions, just for the morbid curiosity. :oI always thought it was a bit of a missed opportunity for tobacco companies...all it needed was one line to turn an intended advertising negative into an incentive to buy even more packets of smokes:

I've been following this story on an overseas board and its has been hilarious to me. I haven't really been following transformer news for a long time. I'm sure this is just obvious and every day stuff (in the world of collectors) but anyway.

People are just crazy there (on the other board).

First it's announced the majority hated it, thought it was ugly

Then it was possibly not going to be available in their country, then many suddenly loved it and needed it.

Then it was announced its deco was slightly changed (not that it was ever that accurate anyway). Now it was going to be readily available and the majority hated it again.

Now it's rumored it is canceled again all together and now people suddenly love it and need it again. Lol

Insanity. :D

Strange days.. A tobacco company missing an opportunity to advertise to a young market, resulting in the chances that a KO Transformer's deco will be more accurate than the official product.

As with Macross product, it is too difficult to stop people privately importing it from a legal country. They could only crack down on stores selling it where they have jurisdiction.

I was totally skipping this MP, but now it's looking like this release is going to be so rare it's making me kinda wish I had ordered him from Japan along with everyone else :rolleyes:

Ehobbybaseshop in HK still has it for pre-order (http://www.ehobbybaseshop.com/?sp=&p=6&cat2=2&cat1=3&cat0=3&id=1075&cat1=3&cat0=3&new=1&more=&lang=en) for US$56, listing 10 units available (which I guess means they have a set number on order already).

I don't see what the issue is for us as non U.S. fans. Just pre-order from a non-U.S. source like HLJ etc. :confused:

As for U.S. fans, does this ruling just mean that U.S. based stores cannot sell this toy, or does it additionally mean that the toy cannot be imported to the U.S.A. by non-U.S. sellers? (so a similar issue that we faced w/ MP Megatron back in 2007) If it's the latter, then I can understand the frustration from U.S. fans, unless I've overlooked something I don't see how it's an issue for us.

Blame the person who made an issue out of nothing and resulted in its current state. Sadly this is coming from a collector from TF forums. I wonder if he/she is hated for doing it.

I am washing my hands of this and I don't want to know how or what is going to happen. I am buying it and hopefully is not way off from what its initial state was. If it gets canned, then so be it. TT will need to replace a number for that piece.

sadly this isn't TT style, and if this is so, I expect the figure's price to be dropped, and actually I would pull out from my order as its no longer a proper produced coloured toy.

The good news for me is I have no emotional attachment to the character. So when repaint like this comes up I don't feel compelled to purchase.

I only collect MP and third party these days and only characters that mean something too me.

Saves a few bucks to boot ;)

Yup, not denying it. I had to lower my expectations a lot to be happy to be honest.

As for emotionally attach to this figure, not really, but I be disappointed which I am that it has changed from initial design.

I dunno how is the end product for this but it doesn't look too good at the moment. And if it changes too much it isn't exactly a masterpiece anymore imo, is a compromised piece.

Remember that copyright/trademark/intellectual property laws are VERY strict in Japan, as is Japanese culture when it comes to the use of other people's IP (thus generating negative publicity for TakTOM). Even providing the means for people to replicate the Marlboro logo via stickers might potentially constitute a legal violation.


The good news for me is I have no emotional attachment to the character.
I doubt most Transfans would have an emotional attachment to Exhaust, unless they happened to have grown up playing w/ a Marlboor Lancia Stratos Turbo Diaclone Car Robot toy. I have an emotional attachment to Magnificus, because I didn't have Perceptor as a kid, but I did get the Microman version that was released here; so I grew up with a black and grey Perceptor. Likewise if they ever reissued G1 Shockwave, I would love to see it reissued in his original "Galactic Man" colours, as that was the toy that I grew up playing with (since G1 Shockwave was never released in Australia). But I have childhood memories attached to those toys; I have no childhood memories attached to Marlboor Wheeljack. So if I get MP Exhaust, I'll be happy - but I won't be devastated if the whole toy gets cancelled either. I'd be just, "Meh. Oh well," and move on. :p Whereas when I got G1 and Generations Magnificus, my reaction was more one of, "zOMG! zOMG! zOMG!" (especially the G1 version) :D

I'd personally get more excited over an MP Slicer. ;)

I think it's fine to have high standards, but also important to have realistic standards too. :o e.g. be aware of what is legally possible for HasTak, as well as what would be feasible for their market etc. What you or I may personally expect or prefer as individuals, may not necessarily reflect what would be viable for HasTak to do. I mean, I would love a toy accurate flat-headed Classicsverse or MP Ironhide or Ratchet, but I know that I'm in a distinct minority who would -- so I don't seriously expect HasTak to make such toys; not unless I want them to go out of business (which obviously I don't :p) ;)

Hate to admit i got the same "addiction" thing of completing everything i started. Now that i am more than half of the MP main line looks like i have to get this guy or it wont look good everytime i see MP-24 after MP-22 :confused:

Feels like Takara will just keep the trend of putting these diaclones in the main line...looks like they got us

Anyway is this going to be released Feb28 or together already with Star Saber? My MP source from Taiwan is already asking me if i want him to send an invoice since it will be released Feb28 so he can reserve me one, 90aud postage included though he never confirmed if Coin is included.

EDIT: seller confirmed total 95aud with coin...hmmm i think i will just save it for MP10 reissue.

Just got a message from Amazon Japan, Exhaust has been pushed back to 31st March. Not sure what that means for non-Japanese retailers.

MP14 Alert was released before MP13 Soundwave thanks to Soundwave getting delayed.

I am assuming of course not 100% we are all adults here and I would just say, keep it low key and not make an issue out of it.

It may however bring alarm bells if TRU decides to import it. I can't say what will happen then. As that will be open to public officially.

I think it would be unlikely that this release would be imported at TRU. It just would be risky, it could draw the wrong kind of attention, but I personally would not have a problem with it. It would be a terrible waste if the stock had to be removed from sale. I can't believe we have like 30 pages of comments for this release :) just saying

Not that I've ever needed to use it (as TakaraTOMY have always been good with providing replacement parts if anything's faulty). Still... weird that they would even have such a policy. Admittedly my knowledge of Japanese consumer law is virtually nil. :p I guess because customer and product service in/from Japan is so exceptional that I've never thought about it. :o

As far as i know in my 3years living in Japan they do not refund but replace the item with another item if you realized you dont want the item after sometime without much questions. Any defective items they do replace immediately like my Toshiba laptop with defective harddisk, they replaced the laptop and not just the hard disk. That is why I am amazed on my first time in Australia that you can refund or replace an item at major retail outlets like Big W, Target, TRU, etc. if you are not happy with it or simply changed your mind.

I suppose a lot of stores are going to have orders cancelled, in fear of the risk due to the legality of the figure. I assume this figure is going to have a very limited run with some pre orders not been filled. If this is the case, its probable we may see a new character at some stage produced from the Wheeljack mold.

would be better if you are specific which stores have an issue to have a better understanding for us where is this source coming from. Were you talking about local shops in HK? If it is, then I do smell trouble for this figure.

My orders have not been cancelled nor have I been told otherwise.
I am however okay with any cancellation, it is what it is, if Takara has broken copyright laws and will be in trouble for carrying on, then so be it cancel the figure and get a new replacement colour or do something else.

This is probably a big controversial figure if you asked me. I did intend to buy it because of Marlboro looked alike but if its not going to work, just scrap the idea.

Ah, a packaged toy for sale, to prove that it should still be getting a release... at least in Japan.

The packaging images have been mirrored here (http://www.tfw2005.com/transformers-news/transformers-masterpiece-47/masterpiece-exhaust-in-box-images-182243/) for when the YJP listing disappears.

I'm relieved to see that the Immobiliser accessory is not a JP Amazon exclusive... since it is on the box, it must be a regular release accessory.

As for the red colouring - we've never had a Transformers release of the "Marlboor" pre-Transformers toy, so it doesn't need to replicate anything that never officially existed in our Universe... and i'm happy with a "homage", which only needs to be close to the original to be classed as a homage.

Two local independent stores in Wan Chai that I deal with face to face. Physical on the ground stores, not online stores...
As Optimus would say "sorry, my bad." I should have elaborated.

They both get their stock direct through Hasbro HK as opposed to resellers.
I am headed out to Mong Kok this week time permitting so will be interesting to see if any of the stores in the malls out there have a different take on it.

If that's the end result, it isn't that bad. I can live with it. I know I am not 100% happy but I think is very minor and some decals would make this toy what I want it to be.

Looks to me, this will be a highly prized toy for collectors.

The latest news is that Hasbro Asia, which distributes in the China, Hong Kong, Singapore region, will not be distributing the figure. That means sellers in those regions may not receive stock, and may not be able to fulfill preorders.

So the only way to get MP-23 Exhaust may well end up being direct orders out of Japan where there are no apparent distribution issues.

I don't really want one but could really be little investment if it still comes out in Japan now :pYeah, I'm going to pick up one or 2 extras when it comes out. Shame my current job prohibits income on the side...:(

Coincidentally, if anyone wants to trade the Immobilizer accessory (EDIT - and/or the coin) for the probable Reprolabels set if/when it comes out, let me know. I mostly want this because 1) I try and avoid multiples of the same character and/or mold (with a few exceptions) and I'm still happy with CHUG Wheeljack, and 2) the idea of a cigarette-advertising-themed modern Transformer is sort of amusing for its political incorrect-ness. If Reprolabels skips on this one, there's a few other things I'd be willing to trade it for instead.

Anyway, I was going to say that RK just answered a question on their FB page about exhaust, saying preorders are ok, but they stopped taking new orders.... I was already hinking this, moreso now with the lack of coin, I support the idea that they are using other sources (tak in jap not hasbro in hk) to fulfill their preorders

I don't want one, as the character has no meaning to me I was just curious as to which of the retailers are still selling them and which ones have pulled out. It seems some people want one now that there is a such a big fiasco about it.

I'm surprised that it is harder to find them now, as there should be a lot more stock now left in Japan that would have been released in Asian countries or sold on to American sources.

On the note, I order two before all the crap hit the fan. I am disappointed that it is no longer the original design, but its still a workable compromised.

I had a look, and since this was the first time I am using HLJ for a pre-order, I panicked when I saw no orders on my orders page, but then saw it had an order waiting for processing to the private warehouse.

I've just changed it to ship when available, so hopefully that sends them both together straight away.

"Both"? If you ordered Exhaust with Star Saber they risk being sent separately as opposed to saving a fair bit by combining them through the Private Warehouse feature.

It's all good, I'm not worried about not getting it, just pointing out the page was gone. RK are great at keeping pages updated with release date info, which is what I was looking for, but without a page there is nowhere to put the info

Twenty of them for sale... he certainly bought as many as he could when the writing was on the wall about this one being prohibited in certain countries.

At 7000yen, that's about US$58... and he's selling them for US$150 plus postage. It would be a shame if he bought them from a JP source before 19 other people could get them before they were sold out everywhere, but I guess that's what scalpers do. :(

They shouldn't be worried, as it wasn't banned in Hong Kong, otherwise Hasbro HK wouldn't have sold it. But it is strange that they are avoiding any possible issues by not listing them publicly. Even RK took down their page instead of just leaving it as "sold out"... so there might be a little paranoia from the dealers after the problems with America and England.

Yeah I did I got no response from that email. I knew it was coming but I remember the site saying it would ship late March and all the other websites had already started getting their stock.

wow, that's an extreme measure to go to to sell some toys. I suppose it would be OK if they advertised it like that, if not I'd be spewing that they had changed something from what I had paid for.

after reading the note from TF source to their customers, I'd be pretty cut. you then have to weigh up if you're going to keep it or send it back and try to get an unadjusted one from somewhere else at fairly high aftermarket price I'm guessing.

I definitely don't agree with what they've done though. Pulling this out of the blue and with no previous notice is very strange, and not the way they should have handled this.

At least with the orange-capping, it was told before-hand and people who bought one knew that it was coming that way.... this was just a total surprise by customers, who got a note with the toy that tried to celebrate the success of getting this toy to them. :rolleyes:

I imagine that TFSource had already bought these toys from a supplier and couldn't return them, so only had the choice of destroying them or modify them enough to be allowed to sell them (they probably contacted the cigarette company to get approval). It wouldn't be a situation that I would envy, but that's part of the risk of business - they took the risk of making a profit from a highly sought after toy, and this time it backfired.
But I don't think they would have had that many units, so if they had just asked their customers first if they still wanted it before they shipped them, they would have still sold off the unwanted units by other desperate customers.


It puts a whole new meaning to the disclaimer - product contents and colours may vary. :p

Okay, so all this hassle seems to be happening from US-based online stores, so as non-Americans, why not just (pre)-order from a non-US based online store like HLJ, Amiami, Chimungmung, AnimeExport, RobotKingdom etc.? Also, wouldn't postage from the US to AU be more expensive than from Japan or Hong Kong (which is where those others are located)? I got mine from HLJ with absolutely no probs. <shrugs> :confused:

Would it be possible for people to try to order one from another non-US source and cancel their pre-order from TFSource?

It's pretty ordinary for TFSource to only notify customers about this so long after the toy's release date. :( But perhaps they only more recently discovered that they had to do this in order to legally sell the toy in the USA, and even though they may be selling to overseas customers, I guess if the transaction is technically occuring in the US, then they're bound by US laws.

People weren't given the chance to cancel their orders at TFSource... the toy showed up at people's houses without warning of the changes.

And if there is anyone outside of America ordering from a US-based source, it's either because they missed out from a cheaper source, or are ordering a number of other items which offsets the extra few US$ on certain toys like this one. Or they prefer to just stick to one or two online stores with their credit card info, and haven't yet been forced to sign up to another source just to get a particular figure.
But I think most of TFSource's customers for JP toys would be Americans who have to pay extra to import anyway.

I just had a quick look at HLJ, Robot Kingdom, Anime Export, and Chimungmung, and Exhaust doesn't even turn up on their web sites! :eek: It looks like they've completely removed this toy from their listings.
