Now, compared to the continued fees needed to legally own a Megatron Transformer, that might seem like good value, but you have to remember that if you get caught with one without the legal approval you'll be in a lot of trouble.

Personally I'm going to try to own it legally.

Hopefully Griffin will be able to find new information of how to be exempted from the fees in Victoria and other states. Or at least the an exemption or reduced amount for the renewal fees every 3 years.

I've personally emailed the licensing regulation regarding the fees numerous times, but their responses so far have been very generic. The most helpful they've been was in clarifying that there are no additional storage requirements other the the imitation firearms section I quoted earlier

I don't know about other states, but my understanding of NSW law is that the retailer would also require a permit and safe storage compliance. The toy shouldn't be sitting on a regular toy shelf but stored in a locked display unit. Some TRUs display their MPs in a locked display unit in the games section instead of sticking them on the action figure aisle, and customers need to present a ticket to the counter and have a staff member unlock the cabinet to sell the toy to them. I don't know if retailers are required to ask customers for proof of being a permit holder or not, but that's a good question.

It would never happen with any retail chains here though, as all Transformers that are distributed in Australia come from Hasbro, and while Hasbro do occasionally do special imports (with wonderful English translated bios/instructions :p), it would only be figures that wouldn't risk violating any laws in Australia. This is why MP Exhaust was never released here (re: tobacco sponsorship laws).

Pretty sure this is a stupid question but I'll feel stupider (:p) getting my Megatron seized.
If I order domestically I don't have to worry about the B709?

I think that may of been the one I saw, sure looked it back in the day, as for the legal wrangling of megatron last I checked trying to import one without the permit only carries the risk of him being seized and destroyed with nothing to actually happen to you, main legal hassle is if you're the one selling.

Could also be an issue if for some reason the police need to do a search on your property, I'm not sure if its back earlier in this thread or elsewhere but most officers *may not* recognize said megatron, unless he's sitting around in gun mode of course.

Truthfully I want to own him legally but judging from your own hurdles I'm not sure what else griffin could do, I'd be happy to fill out a form and a proper cabinet, but every 3 years just to keep him, why can't they just say...I don't know keep a register on people, pay once, go on it, it really does sound like money gouging to me personally (that and my main hurdle is still getting a reference to just sign me off on this :( )

I'm starting to think I might need to let him go.

The B709 form is an import permit. If you aren't buying it from overseas, or bringing it into Australia in person, you don't need that Customs form when buying a Megatron toy.

I am fairly certain I saw a hobby shop in Sydney (the one in Market City that has finally closed in the past 3 months) having it on display for a highly inflated price. I should have checked with them if they had a permit.

I think people need a dash of realism - none of these little anime themed hobby stores will have a permit. They wouldn't even know its needed. And why would they - if you weren't a TF collector and knew about this import restriction you'd also be none the wiser as well.

Ugh. My latest response from the Licensing regulation department was very condescending with regards to the fee renewing an approval.

The generic Megatron is a imitation weapons is prohibited blah blah blah, and "A person ‘off the street’ who is found to be in possession of an imitation firearm without holding a Prohibited Weapons Approval or covered under a Governor in Council Exemption risks being charged with possession of a prohibited weapon and is therefore possessing the imitation firearm illegally. "

And also the fee is "set by the Control of Weapons Regulations 2011" and covers the cost of "processing, assessing and maintaining a weapons approval, there is no intention to bring in ‘discount’ arrangements for specific weapons."

They just don't seem to want to comprise on the the fees involved at all. The spiel that $188.20 every 3 years covers the cost of having an approval is bullshit, considering NSW charge only $75 for 5 years and can be waived by being a legitimate toy gun collector.

I already have more than enough reasons to hate this state, now its at a point where my hobbies are concerned.

They just want our money, what would the money for a simple approval be used for, is there a register, do they do house inspections on those who paid?

Maybe if they chucked in a free weapons storage case and updated it every 3 years it'd be a greaaat incentive.

Okay, so the new MP megatron will get sold by some sellers in Australia, so if I order from them, and they are in whatever state, and they ship to me here in WA, is this an issue as I'm only buying from one state to another?

Last time somebody said WA was exempt or had diff laws, but what about buying from other states in OZ that DO have those prohibition laws?

Just curious, as I want to buy a MP Megatron 2.0 - but will avoid it there is any chance of losing the toy and my money. :confused:

Requirements: (WA)
To import - Obtain a Police Certification Certificate B709 (application form is here on their Permits page), and when the Permit is sent to you, give it to Customs to release the toy to you.
To purchase domestically - No permit required if already in the Country.
To own - No permit or license required, but needs to be for a Lawful Reason and Purpose (keep it with your collection, so that if you are ever challenged by Police, the proof of a Lawful Reason is surrounding the toy - don't carry it with you in public as that would not be a Lawful Reason unless you can prove that you were just transporting it to or from a place of purchase/pickup).
To sell - A seller of imitation firearms must comply with the Weapons Act 1999 and Weapons Regulations 1999. Imitation firearms cannot be sold to juveniles (Person under 18 years of age).

Didn't know about all this but just got MP36 the pre-order from PremiumCollectables.

From their link, it says that they're shipping from QLD. Since I'm from QLD as well, I'm guessing that there's no need to apply for permits as it's no longer imported. I'm assuming that PC would have handled the permit to import it.

Would this be correct?

It doesn't look like I'd be able to register with the Megatron Club, as they only provide assistance to residents in NSW, while I'm in Victoria.

Therefore it doesn't seem like them putting forward an application Department of Justice and Regulation (DJR) will work, since they're based in NSW and I'm in Victoria, but it's nice they're looking into it.

QLD is fine - you don't need to do anything, as the import permit is the only thing required for Megatron in QLD, and you aren't importing this toy.

NSW requires both an import permit (if you are importing), and an ownership permit.
If you are buying from a source that already has them in Australia, you would only need the ownership permit... if you want to legally own this toy.

WA is like QLD - you don't need a permit to own.

So, I've been looking for details of exactly how a replica firearm must be stored in NSW.

Section 41 of the firearms act for a category H firearm.

Gok, I don't know where you get your plastic box with a lock rule from but I'd like to see the regs you're complying with and how I get the officer approving my application to use those regs instead of the NSW firearms act above.

Wow this is confusing, the megatron club site says they worked a deal out that will allow you to display MP-5 in a lockable case.

but thats for mp-05.. and MP-36 looks alot different but at distance can still look like a gun so maybe the same rules. Also Shockwave looks like a gun too does that also come under the rule?
Most links on the Megatron site dont seem to work anymore and being that the latest update is 2011 i am thinking its a bit out of date.

So all i need to know is if I am in NSW with a Transformers collection what do i need to do? also does this apply to all variants including 3p figures or is it just the name Megatron that brings attention.

I know all about the replica gun licence requirements etc. and that's all fine, but is there anything in any of our state legislation requiring the blaze orange plugs on these or is that purely a US thing?
I know it's not required in Japan and Megs won't come with one installed out of the factory (US sites are all stating they'll be opening the package to glue the plug in) but will PC have to do the same here in Australia? I've already pre-ordered mine last night (pissed off with myself because I totally forgot about PC's 10% discount code they FB'd a few weeks ago) but just curious as to whether PC will need to install the orange plugs in these to comply with any local rules?

Orange plugs don't do anything LEGALLY, if they got a plug and are detected in customs it will get confiscated, pc states nothing about plugging them up because the orange plug thing is purely an american thing.

Therefore, getting one with a plug won't save it, and if you get it from an aus seller or japanese seller (unless it states, hlj was selling mp05's with the plugs apparently as a separate listing) you won't have to worry about getting the plug at all.

As a minor you're not old enough to obtain a permit. Perhaps one of your parents can obtain one and be the legal owner of that toy (and undergo safe storage requirements etc.).

Orange barrels (and the colour of toy guns) in Australia are legally meaningless. Toy companies include them as a courtesy to help make the toy look less identifiable as a weapon but they mean nothing.

Here is a visual guide as to which kind of Gunformers are and aren't prohibited in Australia (and thus require a permit to import and may require a permit to own depending on where you live).

The protoype Hasbro reissue Megatron (blue and orange) was never released, but it too would be equally prohibited in Australia. The orange barrel may work in other countries like the USA but not here. So if you're going to get a prohibited Gunformer (after obtaining necessary permits if required of course), then you might as well just get the regular versions without the orange tip.

Thanks for clarifying. And just to be clear, I was asking out of curiosity as to what to expect from PC, not as some way to try and get around the state legislation. As ridiculously stupid as these state laws are, they nonetheless are the law.

And I'm just curious, if a chain store like say TRU for example sold any of the Mp-megatrons, WITHOUT any kind of permit in say VIC, NSW, would that mean that legally the police could confiscate the entire stock?

Assuming it had already passed through customs without been noted.

And someone mentioned on the previous page, do all the same rules apply to the 3P megatrons such as Mightron etc? I assume so, seeing as their gun modes look like real guns.

It's exempted because Nerf guns aren't classified as imitations/replicas. That's why Hasbro can sell Nerf guns. CHUGUR gun Megatron transforms into a Nerf Maverick.

Although more likely Hasbro would be made to recall the product, as happened in 1984-85 here (do you not remember this, or did you live in a place where the toy was never released at all? :confused:). I remember seeing Megatron on shelves for a while and then it was recalled. There was even an article published about the recall in the newspaper because my mum told me about it. I knew a few people who managed to find Megatrons interstate after the NSW recall - one kid in my school did this and was the only person I knew in the 1980s who owned a G1 Megatron toy.

Now this happened over 30 years ago when Customs weren't even looking for this toy (that didn't happen until 2007). Hasbro evidently managed to get their stock through and even distributed into stores until they had to do a product recall. I highly doubt that it would happen today. Hasbro's own legal department would most likely block the idea before it ever happened, and there have been quite a few other examples of potential ideas being blocked by Hasbro Legal. e.g. Hasbro was unable to release Brave Maximus in RiD2001 because that mould no longer complies with contemporary toy safety standards (it fails the drop test). This is also why Hasbro will never be able to reissue Fortress Maximus either. Heck, look at the blue and orange G1 Megatron in the graphic that I posted. A prototype was made (which is in the photo) but the toy itself was never put into production because it never made it past legal. Even with all that orange it still failed because the shape of the gun is still a Walther P38 - colour is irrelevant.

FUN FACT FOR KIDS: In 1985 I was 5 years old and living in New Zealand - too busy watching the cartoons and stuff to be concerned about being shot my Megatron. Shockwave always seemed scarier anyhow, he never said much and you always KNEW he was up to something.:cool:

I've never seen the G1 megatron toy, nor even half of all the G1 toys that got released here, I saw a few in stores back in the day, owned 4 or 5 between the ages of 0-12, then I had like an odd mix of g1/g2 when I as about 14, perhaps 20 or so from a friend.

One time when I first lived in perth a guy had a collectibles store that had old loose g1 toys on display in a big cabinet, don't remember what, but that's the most different g1 TF toys ive seen in one spot , other than fast forwarding to the modern day where i but em like candy, and browse lovely amazing collections over at TFW, such as Griffin's EPIC! collection.

I plan to buy a reissue (non ko) G1 megatron at some point, which is why I started reading this thread, but I've also been tempted by the various 3P gunformers and now of course MP Megs 2.0 - Back in Style!

I also have family/relatives (and toys) in VIC, so if I buy something there, didn't want to have it confiscated by the fruit police at the border. I drove here to my most recent relocating to WA, so went through the actual border thing, the guy was super nice - more so than those grumpy airport types!

Not everyone here has been a collector since the 1980s, and as one who was, I didn't even know about this either until at least a decade later, as I wasn't even aware of it being an issue at the time... considering how many loose Megatron toys I found during the 1990s at flea markets and garage sales. I ended up having 3 or 4 junkers at one stage, before getting a minty fresh one several years later, probably one of the early millennial reissues.

Batfan007: NZ may have actually released more G1 Transformers than Australia. There were a few toys which were never released here which the Kiwis got, one of them being Shockwave! So as a kid growing up in NZ you may have seen Shockwaves in store, but we Aussies never did. The closest we had was "Shackwave" (pre-Transformers version) - I personally grew up playing with a "Shackwave." We also never got Chop Shop, Barrage, Ransack or Venom in 1985 whereas NZ did!

Does anyone have any news regarding attaining MP 36 Megatron legally without having to pay close to $190 every three years.

I never received a response from the Department of Justice and Regulation, despite a representative of the Firearms Appeals Community claiming to forwarding it to them. I've since asked for the Department of Justice and Regulation's email address so I can follow up myself. Last time I checked their website this email address was missing, which was why I ended up sending my query to the wrong department.

I really just want to get this all sorted out because it'll suck if I'm not able to keep my Megatron despite paying for it at PC, and I doubt they'll be willing to give a refund.

When I get more replies back from the relevant departments I will post up the information and updates... so that it isn't just a trickle of information that people will lose among the feedback posts.

Even though it takes time to get replies and action from them, especially at this time of year, there is still a fair bit of time before the new Megatron is released... and I am trying to petition to have a "registered toy collector" exemption for states like Victoria (like NSW has).... but if they get too many people asking the same questions about the matter, they might start ignoring you and me, because it is just an easier option for them (our toy collecting is not a priority to the Criminal Justice System).

Thanks for doing this and responding. The legal issues with this toy just has me on edge.

It had been almost a month since my last email to a relevant department so I only sent one this evening to show that I was still interested in the issue. I'll follow your advice and not email regularly.
