If I recall NSW has the megatron club to take care of that, would we here in vic need to form something like that as well?
The cost to legally own him is off putting to say the least but to join a club for a more reasonable fee would be great

It looks like MP-36 will be classified as a prohibited weapon (not an imitation) in NSW and illegal to own because of the silencer attachment :confused:. I'm waiting for the final decision.
Also learnt the only Megatron the current permit covers is MP-05 :eek:.

Australian gun laws are retarded. I'm all for gun control but come on.
I'm not sure how or if NSW will affect other states. Their decision might influence other states but I don't think it's likely.

I made my own enquiries. They've had a few applications come through.
The decision has come through and I will be notified tomorrow.
As I understand it, prohibited still means that the toy is legal to own with a permit and safe storage compliance. So nothing's changed there. Secondly, G1 Megatron has the silencer and that toy also fell under the same legal classification as MP5 Megatron - i.e. prohibited (legal to own with permit and safe storage).
1. I'm not sure what permit is required (I'll ask tomorrow), but MP-36 won't fall under the imitation firearm collector permit.
2. It's the first question I asked when they mentioned the silencer. I was told that G1 Megatron does not fall under the current permit and that the permit only applies to MP-05 (no silencer).
I look forward to what they say as when I spoke to them just then they told me that just because it has a silencer that does not make it a Prohibited Weapon and that they thought it would be an Imitation Firearm. I spoke to someone in the permits and importations area in NSW police.
They suggested that I contact Border Force as they will be the ones to classify the toy and NSW Police will simply apply that classification to the law as it stands in NSW.
Anybody that has their license ever go through the inspection process? What is the safe storage requirements? I've got security grills on the windows and the door has a key lock. Do I need to have a bolted down safe?
I have not been through the process but the requirements seem more stringent.

Just remember, if you successfully jump through every hoop put in front of you to legally own Megatron, all you achieve is the police/relevant authority for these licenses knowing you own one, for the low low price of $188 every 3 years. And if you stop paying/renewing that licence, you then become a known person with a prohibited item in your possession. Pretty easy for them to confiscate the toy/fine you/etc if they so please.
Ask yourself this - if a fellow collector just gave you a Megatron gun toy to keep, would you go through all this effort for a permit after the fact? Or would you just add it to your toy shelf and go on with your life?

No they dont, they cant divulge private customer information to the authorities just like that, I'd assume there would have to be warrants involved to obtain that data.
If it was somehow a requirement as part of purchasing the item, I'm sure PC would have had that in place as part of the purchase, just like how they put a disclaimer saying all stock will be road freighted, no express (as predicted here and here )
My concern is that PC may not have actually thought about this before doing all the pre orders as they weren't around for MP5 and may not know the requirements.
I would have thought they would need a special import licence and then be required to only sell to those with permits.
FYI I obtained MP5 and got the permit. Didn't cost me a cent, no cops have ever visited my place, and the permit lasts 5 years. Not a real hassle and I'd rather ensure I legally own it.
Well apparently they sought clarification and legal advice about importing it and the selling it to customers other states - it was on their facebook from memory. That being said, they're getting into the country so no one needs an import license if they're getting it from PC.
As for the permit well, be glad your state government at least came to the table and agreed on the Megatron, unlike us Viccos who were given a big piece of bugger all :rolleyes:
I'm hopeful that the Megatron club guys will somehow pull through and be able to be part of the organisations exempt from the permit fees in Victoria.
Otherwise I'll either have to go get a lockable case and the permit, or cancel my pre-order from PC. I think I remember reading that PC said they wouldn't do refunds, but that doesn't seem legal.
The Megatron Club is no good in Victoria, that has been stated a few times already. The Victorian authorities do not care about generating any exemptions, you either pay the 3-yearly permit fee and get a lockable case, or you just buy Megatron anyway, or you just dont buy him.
So basically all I should do is join the Megatron club and it's alright? Better tell my mate about this
According to what danny-boy has reported, the Megatron club only covers MP-05.
My first point was wrong as I was told I had to wait for the verdict and that the outlook might not be good. Thankfully it was all good.
My second point is true. I was told the current permit was only valid for MP-05 when I made the silencer comparison to G1 Megatron.
Edit: You have to be part of the Megatron Club no matter which version of Megatron you have or wish to purchase.

Should of just kept it on the down low and it would have all been hunky dory, peaches and cream.
Now the authorities have a reason to start looking.
I called up the Firearms registry and spoke to a lovely woman by the name of June - I was advised that the rules had now changed in the ACT to distinguish toys like this from imitation firearms and that as far as she was aware, all that was needed was a B709A, but she suggested emailing them about it - mentioning what the figure was and why I wanted to own it.

I'm not even going to open mine & they want me to jump through all these hoops like a circus seal for a dinky plastic pistol. Yeah, nah.
It's clearly an imitation of a firearm and would fit in the various prohibited categories in States and Territories where MP05 was also prohibited. I'm working on getting the Megatron Club registered in Victoria to help members from there, but the NSW system is still essentially the same, with some minor form changes.
There is no point arguing about it being a toy, what it looks like, that there are other similar things on the market/Reject Shop/Easter Show, etc. The law is clear on this.
MP-05 was the impetus for the Megatron Club's creation, but we have successfully extended it to other initiations, such as G1 Megatron, and some other replicas (although no guarantees). MP-36 is essentially the same as MP-05 and G1 Megatron in this regard.
While the notes on the Megatron Club website need some updating (web page management isn't my strong suit) we have tried to steer clear of specific wording so that the permit can be adapted to similar imitations.

Also while you're here, is it legally possible for an Australian store to refuse a refund for a pre-order such as Megatron? I just want to be covered in case I have no other option but to cancel.
If this club can't be recognized in Victoria for an exemption, then I'm going to have I'll need to scrape together roughly $180 for the permit.
I also still need to get around to getting a lockable case for this. Since money's tight right now I might just get a lockable cube instead of tower.
There's still time between now and when stock arrives in Australia late April, but I have to admit I do feel a bit worried as the release date gets closer each day.
