    Default Paypal refund

    Hey guys,

    I've recently had to open a dispute against a US seller who did not send the item to me (USD130++ = back when AUD was 0.88 to USD).

    I got this reply from paypal:

    After careful review, we have concluded our investigation of the Buyer
    Complaint described below.

    We have decided in your favour, however, we were unable to recover any
    funds from the seller's account. As stated in the PayPal User Agreement,
    recovery of funds associated with a Buyer Complaint cannot be guaranteed.

    Please know that we will make our best effort to recover the funds in
    question if they become available in the seller's account in the future,
    and will take appropriate action against the seller. Such action may
    include issuing a warning, a temporary restriction, or terminating the
    account. Keep in mind that PayPal uses a number of factors, including
    member complaints, to determine when to take action. Due to privacy laws,
    we cannot discuss the details of any action taken. We hope you understand
    our policy and that it reassures you that you are safe using PayPal.



    Does that mean I'm USD130 broker? Can the fund still be retrieved even if the seller has been unregistered and possibly never gonna have money in his paypal account?

    I don't see why we pay paypal so much fees when they can't guarantee us our refunds...

    I have had such an experience with paypal before. They ended up paying out of their own pockets to refund your money, but it takes awhile, so hang in there. Call them up and speak to a representative to confirm so you can rest a little bit easier mate. This was a while back so I'm not sure if the same rules and conditions applies. Also it appears to be a case by case scenario, so the outcome may not be the same for your situation. Best of luck with it.

    and that is why i always fund paypal with my c/c so i can open up a dispute with my bank, in a worst case scenario.

    I've had a couple of those emails, and unless your within the timeframe of your bank to lodge a dispute with them - you are basically out of luck.

    How did you fund the Paypal transaction? If you funded with your credit card, you can do a charge back with your bank.
