The listing has mentioned that its "New Unused", but you could always send the seller a message and ask them to verify if the item is brand new and never opened before. Always a good idea to get everything in writing. In the case of a dud, eBay's always on the buyer's side - especially if you have evidence. I've actually bought a some very cheap items on eBay because the seller neglected to list proper photos - Classics Ramjet for $30.
