I would not be leaving negative feedback at this point as its still early, but that's completely up to you. If there is a chance you can get reimbursed, I would keep things civil for now.
Thanks for your help. At this point I am just playing the waiting game to see what he replies. I am not positive that I will get any sort of reinvestment but I want to see this through as I don't like letting scumbags off.

Take into account that sellers may intentionally price their items lower and mark up shipping to avoid paying excessive ebay fees. I bought a Gundam Kit from Hong Kong for only $1 but the shipping was $45 - while I didn't ask him why shipping was so high, I put 1 and 1 together and figured it out since the kit was selling at about $30 from other sellers.
If I want your opinion, I'll give it to you

This was an auction not a bin price.

The shipping price reflects more than just the postage: the materials, time, and care in packaging to ensure the items are delivered without damage.
That was his reply. This was mine:

I am sorry but given the old shirt box and crunched up newspaper packaging, it does not reflect $40+ worth.

I am afraid if that's your stance, I will have to report you to the Trust and Safety section of Ebay as I believe you are scamming me by deliberately overcharging on shipping and possibly doing the same to other buyers.
It's a long shot but I hope its enough to give him pause since he doesn't seem that clever given his response to what was very poor packaging.

Care in packaging? From what you are saying, sounds like he is just wanting more money for something so little. The way he can work the system is overcharge on shipping. I notice alot of that on Ebay these days.

Well played sir! I would have probably even mentioned that you are a member of a large online community and may post your experience in dealing with him whatever the outcome

    Good luck Kup.

EDIT: I forgot to mention (but you probably know this already), if you are emailing each other make sure you do it via Ebay rather than directly as they are able to retrieve these when investigating a complaint.

I wonder how much he charges his mum (I assume he still lives with her) to make him a cup of tea given the fact that it takes at least $40 worth of effort to get a cup from the cupboard alone, then she has to walk to the fridge twice (once to get the milk, another time to put it back), carefully measure sugar if needed and then go to the trouble of stirring the whole thing AND bring it to him. Plus you have to factor in the time needed to wait for the tea to brew (time is money!). I think you got off lightly only being charged an extra $40, Kup.

The seller replied again insisting that the shipping cost was justified. I spoke to ebay and explained the situation. The ebay support guy told me that what the seller is doing is a clear violation of ebay policy and gave me the direct email to report him to the Trust & Safety department.

It appears that I am not the only one since other users have begun to leave neutral feedback due to similar over charge in shipping issues.

I have sent another PM to him explaining that his selling practices are indeed violation of ebay policy with attached proof of it and gave him another chance to refund me the excess shipping cost before I make the official report.

Let's see if he is reasonable about it.

The issue with over charging on freight on ebay has becoming a real problem in the last 2 years, thats why they have start to implement set charges for certain items, such as cd, dvds and books because people were being charged something like $20 for postage and handling, for something that cleary doesn't cost $20 to post.

heres a couple of examples of over charging.Just F^&king rude.for that price i want it wraped in gold.

    $39.37 for shipping. http://stores.shop.ebay.com.au/Vinta...__W0QQ_armrsZ1

    $60.75 US http://cgi.ebay.com.au/TRANSFORMERS-...item35a2db01a6
