Angry Ebay item not as described :(

I won an Armada Tidalwave auction a couple of days ago and it arrived on Monday but it's missing a few things that should be in it.

    Here is the auction.. http://cgi.ebay.com/ws/eBayISAPI.dll...=STRK:MEWNX:IT

    I received..
    - Armada Tidalwave
    - Instructions

    Did not include..
    - Minicon Ramjet
    - 2 missiles

The description does say "Tidal Wave with Ramjet Minicon" which I was definately expecting to be included.

The description also says it "toy is preloved and comes complete with instructions for transforming" but now i think that is just clever wording to make me think the missiles were included.

    I paid via Paypal too.

How do I go about this, do I email the seller first or is this what the dispute system is for (and to cover my ass)?

Does anyone know this Perth seller (natalie9061)? Or do we all stay away from her auctions?

Message her and let her know that you're not happy and you feel as though you've been misled.

Request a partial refund or full refund (but this probably will make it not worthwhile since you would probably have to pay for return postage and most sellers would not be prepared to re-imburse that cost to you).

If all else fails, file a Paypal claim as item not as described and they will investigate and refund your money if they find it is in your favour.

If you paid by other means, then you're kinda screwed on that part and will basically have to plead with the seller to issue you a (partial) refund.

Worse comes to worse, you can threaten to leave negative feedback and not fear her doing likewise for you (as sellers are no longer able to give neg feedback to buyers)

Just my 2c worth.... hope it helps

dispute and quote these 2 auctions and ask for partial refund if ramjet minicon is not available...

guess nothing you can do with the missing missiles as she might mean "complete with instructions"

Silly question but is Ramjet actually In his hiding space in the deck? When I sold my tidal wave I got abused for not including him. I put him inside so he woudlnt get damaged in shipping.

Seller does have 100% feedback so hopefully you shoudlnt have too much trouble, hope your issue is resolved without too much hassle!

Yes my first thought was this. The seller could have put it inside the hiding deck in Tidalwave's right arm as he folds to fit in that space.
Have a check first, if he's not in there, PM, email first the seller. If he really is missing the seller might have him and you could work it out to have it sent free since it's her fault. If it really is missing then ask for partial refund... hope everything works out. Cheers!

I had checked the hangar for Ramjet and he is indeed AWOL. This is my first "issue" with eBay so I really appreciate the prompt advice from everyone so far. Thankyou all.

And yes I did pay for it via Paypal (just some more info).

I would add a note in about the missing missiles as well. Even if the seller meant that it the instructions "complete" the set, the wording is deceptive and at the very least open to misinterpretation, which is what may have happend here.

If I bid on that auction, I would expect, missiles, Ramjet and instructions as well since they would be what makes it complete IMO.

It also just possible that she had forgot to put it in with the package, in which case she should send it free of charge. In my experience, don't be too hasty to assume you have been jipped. Best to start out on the right foot and be polite about it. If she is nasty about it, then aim for the jugular

Completely agree with you. Sometimes they are just honest mistakes and it always pays to give the seller a chance to rectify the situation.
