    The ones I got (one for me and one for my mate) looked like they had been resealed/double taped, not sure if that indicates they were returns or if they just came like that but would be good to know what to look out for.

    Don't quote me on this, but I think I read that another board member mentioned that they encountered an issue with the trailer's door hinge?

    Cheers for the replies lads, mine seems fine in both regards so I lucked out I guess, either that or the Bankstown guys sent the faulty Ops back. shrug~

    If the toy is faulty they MUST recompense you as a customer. If they refuse, then report them to the ACCC. I've exchanged a toy before because of significantly flawed paint application (I bought a RTS Perceptor with a massive scratch down one side of his face).

    So even if the packaging is already broken they should replace it then? Coz Blister packaging of Hasbro isn't exactly the same as TakTom's where you could put the figure back neatly.

    No, I said if the toy is faulty.

    Here's some exerpts from the ACCC: Consumer Guarantees:
    When you buy goods, the seller guarantees that:
    >> goods will be of acceptable quality
    >> goods will be fit for a particular purpose
    The manufacturer guarantees that:
    >> goods will be of acceptable quality
    >> goods will match their description
    >> they will honour any express warranties
    >> they will provide repairs or spare parts for a reasonable time.
    ..................
    If a product or service fails to meet a guarantee, you may be entitled to a replacement,
    repair, refund or other remedy.


    What is the definition of "acceptable quality"?
    There is a guarantee that goods are of acceptable quality if they:
    >> are safe, durable and free from defects
    >> are acceptable in appearance and finish
    >> do everything that they are commonly used for.

    So the trailer door for MP Optimus Prime must be able to function properly. That is a COMMON use for that part of the toy. If it cannot, then it is not acceptable quality. If you try to stand on the trailer and it breaks, then the retailer does not have to recompense you since it is not a common use of that toy.

    A seller can exempt themselves of this by alerting the consumer of any defects (and usually reducing the price accordingly).
    Where a seller alerts you to any defects before the purchase, you should inspect before you buy to make sure you are still happy to go ahead. Otherwise you may not be entitled to a remedy.
    For example, I bought Armada Powerlink Optimus Prime from... I think it was Toyworld in Wollongong, for only $30 because it was missing one of the smokestack/weapons (and had been opened before and refunded). I cannot then take it back and try to claim recompense because of the missing weapon, because there was a discount sticker that alerted me to the missing accessory.
